This Site is used to provide information about our services and to accept project inquiries. Submitting a contact form or requesting an estimate does not constitute a binding contract. All estimates are provided in writing and are based on the conditions observed during an on-site visit. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing. Project dates are scheduled upon execution of a written contract. We will make reasonable efforts to complete work on or near the scheduled date. Delays due to weather, material availability, or other circumstances outside our control do not constitute a breach of contract.
If you need to cancel or reschedule, please contact us as soon as possible. Cancellations made after materials have been ordered or crews have been dispatched may be subject to a cancellation fee as described in your project contract. We will communicate any applicable fees to you in writing before charging them.
Payment terms are specified in the written project contract. In general, a deposit may be required at the time of contract signing, with the remaining balance due upon completion of work. Invoices not paid within the timeframe specified in the contract may be subject to late fees as described therein.
We reserve the right to suspend or discontinue work on a project if payment obligations are not met. The customer is responsible for all costs of collection, including reasonable attorney's fees, if a past-due balance is referred for collection.
We provide a limited workmanship warranty on paving and installation services as specified in the written project contract. This warranty covers defects in workmanship under normal use and maintenance conditions. It does not cover damage caused by:
Material warranties, if any, are governed by the manufacturer's terms. We do not extend manufacturer warranties beyond what the manufacturer provides.
You agree to provide accurate information when requesting a quote or submitting a project inquiry. You are responsible for ensuring that any required HOA approvals, permits, or access arrangements are in place before work begins, unless we have explicitly agreed in writing to handle permitting on your behalf. You agree to keep the work area clear of vehicles, equipment, and other obstructions as directed by our crew before and during the project.
To the fullest extent permitted by applicable law, Bakersfield Asphalt Paving Company and its employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of this Site, the services we provide, or any failure to perform services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific project giving rise to the claim.
